Can you indicate what the legal grounds for the objections of Lev-Ran's attorneys to the interview were ? I don't think they were apparent from the previous correspondence of even from his attorney's October 12^th letter. The development while unfortunate was not entirely surprising but it could be helpful to know exactly what the legal bases for his objections are.

In summary of our conversation; I understand that the appearance before the Magistrate on 2 November is not when the actual MLAT will be conducted but rather a preliminary proceeding at which the time frame and the details of the actual execution will be set and it is not necessary or customary for the requesting country to be present at this preliminary meeting.

As discussed we would be happy to coordinate that the interview take place in our local embassy if possible and I reiterate that at this time we wish to interview Mr. Lev Ran as a suspect.

Due to the new date of the appeal and the likelihood of the execution being postponed we would like to ask if it is possible to preemptively postpone the date of execution to sometime later in November (between 5-16/11)?

The reason for the preemptive change is that we do not want to send our officers if the execution will not take place during their presence, we must take into consideration that once we confirm the payment for the flight and hotel it is non-refundable, we currently have reservations in place but have not sent the final confirmation due to this matter.

If it is not possible to change the execution date prior to the court hearing on 31/10/17 we kindly request that you contact us immediately after the case is heard in court and we will proceed based on the decision, given the importance of being present during the execution.

Thank you Ms Matima – in light of this the MLA may not proceed on 2 November and will probably be postponed to a future date – we are in informal  discussions with his counsel but it all depends of what will happen in court on 31 October re their motion.
