לבקשתה של אתי, מעבירה לעיונכם עדכון שהתקבל מיצחק בלום בנוגע לחומרים משוויץ.

 

 

 

היי אתי,

 

ניהלתי את השיחה עם צ'ארלס נברו וזה היה בעיקר חיובי.

 

הוא אמר שלמרות שאין אפשרות של שיחות משטרה למשטרה בעניין, עקב סודיות הבנקאית בשוויץ, הוא היצע משהו שהיה פחות או יותר אותו דבר ושאכן עשינו ב – BSGR מול קלאדיו: הוא אמר שאנו יכולים לשלוח אנשים לשוויץ (לא חשוב לו אם מדובר בחוקרים או תובעים או שניהם ביחד) שיוכלו לעבור על חומרים שנאספו כבר בשוויץ ויוכלו גם להיפגש עם גורמים הרלוונטיים בעניין. הוא אמר שבדרך הזאת נוכל להעריך את הפוטנציאל של הראיות בשוויץ וגם את הכיוונים שמצאו שם מהחשבונות שהיו נושא הבקשה וחשבונות אחרים שהתגלו בשוויץ. הוא הדגיש שהפעולות האלו הם יהיו מודיעיניות באופי. הוא ציין שלא נוכל לקחת חומרים בחזרה אתנו או לעשות שימוש במידע שנקבל עד לאחר "הליך רגיל" בשוויץ. (כזכור לכך מהרבה תיקים אחרים, "ההליך הרגיל" לשם העברת החומרים אלינו במסגרת ה – MLA  ידרוש הודעות לבעלי החשבונות (קרי החשודים) על עצם קיום ה – MLA  בשוויץ (שטרם התגלה עד כה ושלא יתגלה לפני הביקור המוצע). במקרה שבעלי החשבונות יתנגדו להעברת החומרים לארץ במסגרת ה –  MLA ייתכן שייקח הרבה זמן עד שנקבל את החומרים לשימוש. אבל כבר נדע באיזה חומרים מדובר ומה יש בהם.

 

שאלתי אותו מתי ביקור כזה לעבור על הראיות יכול להתבצע. הוא אמר שהוא צריך לדבר עם הממונים עליו ושזה לא החלטה שלו בלבד, אבל הוא חושב שיש אפשרות לבצע את זה כבר בדצמבר. הוא אפילו הציע את השבוע של ה – 10 לדצמבר.

 

ואז שאלתי אותו דוגרי האם הוא, שכרגע יותר קרוב לחומרים שנאספו, חושב שזה שווה ורעיון טוב לנו שנעשה את הנסיעה ואת הביקור הזה. אחרי היסוס שוויצרי טיפוסי הוא ענה שלדעתו יש דברים מעניינים ושהנסיעה יכולה להועיל ("be useful") וש -  "I think the results will be good".

 

אמרתי לו שנעדכן אותו מחר לגבי תגובתנו להצעתו כדי, בהנחה שאנחנו רוצים ללכת לכיוון הזה, יהיה אפשר להתקדם במהירות בארגון הביקור.

 

נראה לי שאין שאלה שצריכים לנצל את ההזדמנות הזאת . נבארו אמר שהוא חושב שאפילו ביום אחד של ישיבות ופגישות האנשים שלנו יוכלו להעריך את הפוטנציאל של הראיות ושל התיק. ברור כמובן שאם החשודים (שהם בעלי החשבונות הרלוונטיים) יתנגדו בשוויץ ייתכן שייקח הרבה זמן עד שנקבל את הראיות לשימוש אבל אז לפחות נדע בדיוק למה אנחנו מחכים. אגב,  אני מזכיר שבאותו שבוע יש ב – 10/12 ישיבת ה – LEO  ב – OECD אז אם מעוניינים אפשר לשלב בין שניהם,  כלומר, להיות בפריז ב – 10/12 ואז להמשיך לשוויץ.

 

יש לציין שבעת כתיבת המייל הזה, העמית השוויצרי אישר את האפשרות לערוך את הביקור הזה בשבוע של ה – 10 לדצמבר. ראו מצ"ב.

 

אז האם לחזור אליו מחר ולומר לו: Lets go !

כבר כתבתי לצ'ארלס נאברו אתמול (ראי מצ"ב). כפי שרואים ביקשתי כמה הסבירים וגם ביקשתי לדבר איתו. ניתן לו יום היום להגיב ואם לא יגיב אהיה יותר פרואקטיבי. אגב, הבשורות החדשות כמובן מעודדות אבל לא הייתי "סוחר עליהם בבורסה" עדיין. אני רוצה להבין בדיוק למה הוא התכוון במייל ולשם כך אכן כבר שלחתי את המייל שלי אליו.

האם ניתן לבקש מצ'רלס נברו מייל המפרט את עיקרי הדברים נמצאו במסמכים, כמובן לשימוש מודיעיני בשלב זה. כמו כן נשמח לקבל ממנו עדכון לגבי ההליכים הצפויים ומשך הזמן הצפוי לקבלת החומרים באופן רשמי.

נדמה לי שהתיק של Defensive Shield היה לכם קצת משעמם לאחרונה, אז אני משתף אתכם במייל שקיבלתי מהעמית שלי בשוויץ'. הוא כותב שהם ממשיכים עם ביצוע הבקשה שלנו והוא מוסר שהם מוצאו יותר ראיות ממה שהם ציפו שהם רואים כרלוונטיים לחקירה שלנו. הם ממשיכים להכין את החומרים וכאשר הם יסיימו את זה הם יתחילו את ה "transmission procedure". למרות שהיה אפשר לפרש את "transmission procedure" בעצם העברת הראיות, יש לי תחושה שהוא מתכוון להליך שיכלול גם את ההליכים בביהמ"ש בשוויץ' להעביר את החומרים. אם כן, המשמעות של המייל יכול להיות "באמת מצאנו דברים מעניינים אבל אתם תצטרכו להמתין זמן רב עד שתקבלו אותם".

 

אני מזכיר שהיו תיקים כמו BSGR שהשוויצרים היו מוכנים על בסיס מודיעיני לשתף את המשטרה שלנו בתוצאות פעולות החקירה שהם ביצועו על פי בקשותינו אפילו לפני התחלת "הליכה מסירה". לאור הלחצים בתיק  Defensive הנ"ל אולי יהיה טוב לבדוק איתם את האפשרות הזאת. אני חייב לומר למרות זאת שהיו תיקים (אולי רובם) שהשוויצרים לא היו מוכנים לתת לנו את ה – "preview" הזה של הראיות. בכל מקרה אנסה לברר את העניין עם העמית שלי.

Dear Julia,

 

Please find enclosed an amended version of Israel's Request for Legal Assistance in the above-referenced criminal matter.  The Request was originally dated  August 10, 2017 and submitted around that time. We were informed at the time that the matter was  referred to the Office of the Attorney General and that your own reference number for the matter was  B-17-3868-1 and that the competent person at your office was Ms. Ludivine Antal.

 

At some point subsequent, we were contacted by Assistant Federal Prosecutor Charles Navarro  of the Division  for International Mutual Assistance, of the Office of the Attorney General.  After very fruitful discussion and very helpful suggestions by Mr. Navarro, we amended our Request to make certain changes that Mr. Navarro suggested to facilitate its execution. Among other things, the request no longer seeks evidence for the purpose of investigating tax-related  offenses.

 

The amended Request takes the place of our earlier submitted request. Like the request previously submitted, the amended request relates to the ongoing investigation conducted by the Israel Police into suspicions of criminal offences, including bribery, fraud and money laundering, committed by Israeli nationals connected to the alleged illegal payments and transactions to and with a foreign public official, the former Minister of Defense of the Republic of Georgia.  The assistance requested is largely to  obtain documents, records and witness interviews from Union Bancaire Privee (UBP) Bank in Geneva. 

 

We assumed that we should resend the amended request through your office, but we will be grateful for any step that will facilitate its rapid transfer for execution to the persons we were in contact with at the Swiss Office of the Attorney General. We have, of course, amended our translation of the Request into French and a copy of that amended Translation is also attached.

 

Please acknowledge receipt of this amended request and we thank you as ever for your valuable assistance.
