Sorry - by Bulgarian I mean Belgian.

Here's a Jurist article on the Dutch decision: http://jurist.org/paperchase/2006/09/dutch-court-cites-torture-risk-in.php

Thanks!

Unfortunately I've looked and I'm not entire sure how to access the Bulgarian and Dutch decisions. When Yonatan comes back tomorrow, I can ask him for help on the German case.

Avishai

Subject: Case-Law: Extradition to Turkey

Hi guys,

First, I need to say that this was not an easy assignment. I found NO ECHR cases that specifically deal with a country's refusal to extradite someone to Turkey - nor any cases in the U.S. or Canada.

By combing through law review articles and Human Rights Watch/Amnesty International reports, I did, however, manage to find 5 cases on the local court level: Greece, Italy, Belgium, The Netherlands, and Germany. My findings are attached.

Also, just now I discovered a sixth case, in Croatia - the case of Basak Sahin Duman, who was granted political asylum by a Croatian court last year, despite Turkey's extradition request.

(Here's a Google translate of a news story on this issue: http://translate.google.co.il/translate?hl=en&sl=hr&u=http://www.novilist.hr/Vijesti/Hrvatska/Basak-Sahin-Duman-Povratak-u-Tursku-cekat-cu-20-godina&prev=/search%3Fq%3Dsite:http://www.novilist.hr/%2BBa%25C5%259Fak%2B%25C5%259Eahin%2BDuman%26client%3Dfirefox-a%26hs%3Dn9v%26rls%3Dorg.mozilla:en-US:official)
