אבינועם שלום,

בהמשך לשיחתנו, בהמשך מופיעות פסקאות מתוך מסמך שמסביר מדוע התלונה צריכה להידחות לפי הדין הבלגי.

במסמך זה בכוונתנו לסקור בקצרה בין היתר את סמכויות בג"ץ ופסיקה רלוונטית. זאת משום שמערכת המשפט הבלגית מתירה דחייה של תלונות פליליות עבור פשעים בינלאומיים במידה וישנה מדינה אחרת עם זיקה קרובה יותר לאירוע ובעלת מערכת משפט הוגנת, נטולת פניות ועצמאית.

1.            Most importantly indeed, the jurisdiction of the High Court of Justice is not restricted and extends to Israeli actions in the West Bank and even to actions in the Gaza Strip or in any area in which Israel, including its army, is operating. Petitions are brought on a regular basis by Palestinian residents, or persons and organizations representing their interests, claiming that actions taken by the Israeli security forces, including activities in the West Bank and the Gaza Strip violate international law .The Supreme Court rules on such petitions, and when justified, issues injunctions against the Government or other relief as appropriate.

 

2.                        When ruling on such petitions, the Israeli Supreme Court has specifically and consistently held that customary international law, including international customary humanitarian law, will be applied, as if they were part of Israeli domestic law. The Court rules that “According to the consistent case law of this Court, customary international law is a part of the law of the country, subject to Israeli statute determining a contrary provision” (HCJ 785/87 Afu v. The Commander of Israel Defense Forces in the West Bank, 42(2) PD 4,35).
