בחיפושים שלנו, מצאנו שני פסקי דין אמריקאים (מצ"ב) של אכיפת פסקי חוץ ישראליים, שבהם השופטים הכירו בהוגנות ובהעדר משוא הפנים של מערכת המשפט בארץ.

תוכלו למצוא את הציטוטים האמורים ופס"ד Kamtech (עמ' 425, 427) ובפס"ד Flick (עמ' 1198).

 

ניסינו לאתר אמירות דומות גם באירופה, אבל נכון לעכשיו לא נמצאו החלטות רלוונטיות.

מאחר ואתן רואות צורך, נוכל להמשיך לחפש אחרי פסקי דין דומים.

Hi Itai,

 

We are working on a paper for Belgium trying to convince the Belgian authorities that are system is independent, impartial and equitable, and someone here raised the point that in private international law cases foreign courts have to decide whether the foreign system is equitable and fair. Are you aware of any foreign court decisions that ruled on the issue of enforcement of Israeli court decisions and held that are system was equitable and fair?

 

We are under a tight deadline, and would appreciate any insights or thoughts you may have into this matter.
