Attached for discussion next week is our latest reworking of the outline, including both your comments and some revisions of our own.
We would also like to clarify one point about Part III that may not have been from the outline. In an effort to focus the memorandum and avoid unnecessary treatisization,
we propose to conduct the analysis in Part III by analyzing each category of cybersecurity measures in the context of the most relevant international obligations. Put another way, we don’t propose to discuss all of the international obligations in the abstract.
We expect that, as with the cybersecurity measures, there will be considerable overlap in the relevant international obligations, and we hope to eliminate redundant analysis where possible. To the extent that specific FTAs include significant variations on
or additions to particular obligations and exceptions, of course, we will cover the variations, but we do not propose to conduct detailed and repetitive analysis under each FTA or BIT.
Finally, we want to flag the possibility that we may need an extension of the deadline for completing the memo to the end of May. If that is something that your team’s schedule
can accommodate, we would appreciate it. We have just been handed some overlapping litigation deadlines on our end, so a short extension would be welcome.
