לא מצאתי את גזרי הדין עצמם למעט תיק זברסקי, שם מדגישים את הנסיבות שהובילו לעונש הקל יחסית לנאשמת 4.

אוראל הסטודנטית שלנו עברה על דוח מחלקת המדינה ואיתרה כמה תיקים – לעיונכם (האנגלית בגלל שכך דווחו לאמריקאים).

 

 

ת.פ.ח 1049/09 (ב"ש) מ"י נ' מחמוד אבו הבירה-  כתב האישום ייחס לנאשם שני מקרים, בהם הבריח 12 נשים ממזרח אירופה לשטח מדינת ישראל לשם העסקתן בזנות. הנאשם הואשם בסחר בבני אדם למטרת זנות. בתאריך 12.9.10, במסגרת הסדר טיעון, הורשע הנאשם בעבירה של סיוע להבאת אדם לידי עיסוק בזנות בנסיבות מחמירות ונדון לעונש של שבע וחצי שנות מאסר ומאסר על תנאי.

 

The State of Israel v. Ortal Hemo and Aa'id Salama et.al.  (Cr.C. 33670-01-13, Tel Aviv- Jaffa District Court).

Defendant 1: inducement of a minor to prostitution, threats, and insulting a public servant.

According to the plea bargain, Defendant 1 was convicted of inducement of a minor to prostitution.

On November 7, 2013, Defendant 1 was sentenced to seven (7) months imprisonment, suspended imprisonment and a conditional fine of 5,000 NIS (1,282 USD).

 

The State of Israel v. Oleg Zaberski et. Al. (Cr.C. 13852-04-12, Tel Aviv District Court)

 

Defendant 4 was charged with assisting in TIP for the purpose of prostitution and assisting to inducement to prostitution under aggravated circumstances.

 

In a plea bargain, defendant 4 was convicted of assistance to inducement to prostitution.

Defendant 4 was sentenced to suspended imprisonment, fined 5,000 NIS (U.S. $1,315) and ordered to pay 5,000 NIS (U.S. $1,315) to a Governmental Fund as stipulated in Section 377a of the Penal Law.

 

The State of Israel v. Paul Vaknin (Cr.C, 38478-09-11,  Be'er-Sheva District Court)

The defendant was charged with extortion under threats, threats, rape and indecent acts.

According to the plea bargain, the defendant was convicted, on December 4, 2014 of inducement to prostitution.

On April 27, 2015, the Defendant was sentenced to 6 months imprisonment, to be carried out in community service, 12 months suspended imprisonment, and 100,000 NIS (25,641 USD) compensation for the complainant.

 

The State of Israel v. Elmaz Muhmatzyanov et. Al. (S.Cr.C 34848-07-12, Haifa District Court)

Defendants 3 and 4 were charged with assisting to leave a country for the purpose of prostitution and inducement to prostitution under aggravated circumstances.

In a plea bargain, defendants 3 and 4 were convicted of inducing a person to prostitution and attempting to induce a person to prostitution. 

Defendant 3 was sentenced to eight months imprisonment, suspended imprisonment, and fined 4,000 NIS (U.S.$1,052). The lenient punishment in this case stemmed from evidentiary difficulties.

Defendant 4 was sentenced to suspended imprisonment and fined 10,000 NIS (U.S. $2,631). The lenient punishment in this case stemmed from special personal circumstances.

ת.פ. 41111-02—17 (שלום רמלה) מ"י נ' ליאוניד זלטובסקי

ביום 20.2.17 הוגש כתב אישום כנגד הנאשם, המייחס לו שלושה אישומים של ניסיון להבאת אדם לידי עיסוק בזנות. על-פי עובדות כתב האישום, הנאשם פרסם דף בפייסבוק ובו הציע עבודה הכוללת רווח גבוה לנשים. לנשים שפנו אליו בעקבות המודעה הציע הנאשם לעבוד במתן שירותים דיסקרטיים, אשר משמעותם קיום יחסי מין בתשלום, עיסוק בזנות. הנא' ביקש מהנשים שפנו אליו לצלמן בעירום ולקיים עימן יחסי מין על מנת לבדוק אם הן רגישות מספיק מבחינה מינית וכדי להעביר את התמונות ללקוחות פוטנציאליים. הנא' אף נפגש עם אחת המתלוננות, צילם אותה בעירום וקיים עימה יחסי מין בהסכמה לצורך בדיקה. 

ביום 24.01.18 הגיעו הצדדים להסדר טיעון שכלל תיקון כתב אישום בלבד. התיק קבוע לטיעונים לעונש ליום 06.05.18.

 

ת.פ. 8764-10-16 (שלום ת"א) מ"י נ' יניב דותן

ביום 5.10.16 הוגש כנגד הנאשם כתב אישום בגין עבירות ניסיון להבאת אדם לידי עיסוק בזנות והטרדה מינית. פרשת התביעה הסתיימה, התיק נקבע לפרשת הגנה ולסיכומים ליום 12/4/18.
