Dear experts,

 

As foreshadowed, the UNCITRAL secretariat, in cooperation with the Government of Israel, is organizing online an expert group meeting on “technology-related” dispute resolution from 15 to 16 March 2021, from 13:00 to 15:30 Vienna time (CET).  This is in furtherance of a proposal on dispute resolution in international high-tech-related transactions made by the Governments of Israel and Japan (A/CN.9/997).

 

We should be grateful if you would kindly confirm your availability no later than 8 March.  While some have already volunteered to make a presentation, please let us know if you are interested in making one (5 minutes) for any of the sessions below.  The tentative agenda is as follows:

 

Monday, 15 March 2021

(13:00-14:00)  Session 1 Desirability of work – the needs of the industry, institutions and tribunals

(14:00-14:30)  Session 2 Possible scope of work

(14:30-15:00)  Session 3 Specific aspects of high-tech disputes that require a departure from general arbitration – time frames, evidence and confidentiality, types of proceedings (expert determination, adjudication)

(15:00-15:30)  Roundtable discussion

 

Tuesday, 16 March 2021

(13:00-14:00)  Session 3 (continued)

(14:00-14:30)  Session 4 Feasibility of work – including the possibility and benefits of harmonization across jurisdictions

(14:30-15:00)  Session 5 Form of possible work – rules, guidance document, list of experts

(15:20-15:30)  Concluding remarks & way forward
