בהמשך לשיחתנו – להלן הנושאים שחשבתי לנכון להעביר לבייפסקי בעל פה.

מדובר ברשימה חלקית (מבוסס על מה שגלעד הכין עם הערות/תוספות פה ושם), אשר בכוונה לא מתייחס לישראל במפורש אלא לביה"ד בכללי. כמובן שארחיב איתה בעל פה להסביר את הנקודות.

Complementarity:

-          Adoption of a broader approach, at least at PE stage, that looks at domestic legal system as a whole (rather than same person, same conduct test which undermines concept of ICC as court of last resort)

-          Alternatives to strictly criminal proceedings as satisfying the complementarity requirement

Gravity:

-          The need for a higher and coherent gravity threshold that is consistent with the original mandate of the court.

Interests of Justice:

-          Need to revisit policy of OTP regarding this test.

Margin of Appreciation:

-          Courts Standard of Review of states actions regarding ICC issues, and need to allow margin, as well as degree of deference to reasonable legal interpretations by the State (even if they differ from OTP view)

ICC and Non-State Parties

-          Argument for extra obligations/more careful policy ICC should have when contemplating exercising jurisdiction over non-state parties including re: margin of appreciation, burden of proof (e.g in complementarity), conservative approach to legal interpretations, role of customary law (e.g.,non-application of non-customary elements of RS on crimes), more stringent tests in PE phase etc.

Public International Law

-          Role of ICC in adjudicating general PIL questions at the core of inter-state relations
