On behalf of Nereida and me, I send you best wishes of a fruitful 2023 and happiness beyond it!
I am sending you attached a version of what we reached about a draft Convention along the ideas we shortly discussed two weeks ago.
As you may notice, we departed from the “parallel proceedings” limitation on subject matter and pushed to “prevention of irreconcilable judgments”. The text, as a consequence, was adapted to that change, but can be easily restored to the “parallel proceedings” limitation.
We concentrated on the “procedural” part of the Convention’s commandments to Courts, trying to find sanctions to parties that do not comply with the effort to prevent irreconcilable judgments (Articles 2bis to 8).
Awaiting for your comments, including on the usage of English language, we look forward to send a new version to the BIMSUS and, hopefully, to the group as a Working Document. It will be good to read from you by Tuesday 10th for that purpose.
