Dear FOTC
Further to Kei's email, I would be grateful if in-person participants could please indicate before 10am CET (if at all possible) whether you will attend this 1.30pm meeting today so that the PB can arrange lunch for you.
Thanks
Melissa

Subject: Re: [FOTC of the WG of the Jurisdiction Project] Draft of a Working Document from Chair
Dear members of FOTC,
Thank you very much for circulating your comments on the document among members of FOTC. I also thank some members who kindly send me your feedbacks.
First of all, I might need to apologize. I might give some members certain impression that the Chair is not neutral in certain controversial matters. I myself just try to describe just the current status of the WG in the draft of a new WD, but it seems that
I might give such problematic impression. Although it is (needless to say) unintentional, but it is crystal clear that the Chair should not have given such impression regardless of whether it was intentional or unintentional. I am sorry for that.
If you have concern, it is OK for me not to submit my WD. It would be true that the Chair should not submit too many WDs, which might infringe the neutrality. I would be very happy if some members submit WDs to the WG. However, there is no WD submitted by the
members on these issues. In order to move forward, it seems we need to have one.
Therefore, I thought that it might be good to submit a WD. But again, if you have concern to proceed in this way, it is OK for me not to submit WDs.
Incidentally, regardless of whether I will submit a new WD or not, I would like to hold an meeting of FOTC at lunc time today. It will be held from 1:30 pm to 2:15 pm. Basically, it will be held in person, but online participation might be possible (but it
is not certain). PB will inform you again by email. For the discussion of this meeting, I prepared a revised draft attached to this email. I would appreciate it if you could attend the meeting if you have time.
Best regards,
Kei

>
> In listening to the discussions, I would have some concerns about a chair proposal for Article 3 unless it were very clear in the WD that that provision only addresses one of the scenarios that the instrument is seeking to address; namely, the scenario where
one court has a priority connection/jurisdiction and the other doesn't. Without such a note, it lacks a link to the other more substantive articles and the two approaches under consideration. I'm sure the intent is not to short-circuit further discussion
on those issues, so it should be made clearer, perhaps in the placeholder for text for Articles 4-7. On the text itself, I think Yael and Eral's comments are helpful.
>
> On Article 8, while we recognize that this issue is important for some participants, others have concerns and based on the discussions so far, it does not seem that there is sufficient consensus to include a new version that suggests such consensus exists.
As such, it seems that the Chair's WD 21 as already submitted can serve as an adequate placeholder on that particular issue.
>
> "See" you all tomorrow and apologies for the delayed response; I am very sorry not to have shared this by 7 p.m. Hague time but one of the many downsides of joining virtually from the Western Hemisphere is that one still has the rest of her day once we are
finished with the plenary session!

America and one from Europe. May the best win! I also hope that in the North American World Cup in 2026 other teams from other continents will also accede to the final stages of the tournament.

> > > > > > With regard to the draft agenda, I think that it provides a good framework for our February discussions. I would only suggest one change in terms of timing. I would suggest to start on the first day with the topic that is now at the beginning of
the second day (rules for filing the gap) because this is a discussion on the core of the future instrument and it is important to have enough time for meaningful exchanges on this topic during the next meeting of the Working Group. This is in no way to suggest
that the topics now scheduled for the first day are less important, but past experience shows that discussions on the first topic can take somehow longer than planned, which would necessarily leave less time for the discussion on the rules that would fill
the gap.
