Dear secretariat,

Following our comments, please see our proposed revisions:

 

 

·        OP 1: Arrangements shall be made to allow delegations to participate at the sessions in-person, remotely and/or in writing  facilitate the remote participation of delegations at the sessions. However, if a Chairperson of a Working Group wishes to encourage in-person participation by delegations, the chairperson can circulate such a proposal to delegations of UNCITRAL member states. If the chairperson does not hear any objections from member states within 28 days, than the Secretariat shall formally issue invitations expressing this preference to all member and observer states. 

 

·        OP 1: Arrangements shall be made to allow delegations to participate at the sessions in-person, remotely and/or in writing; however, in light of the current state of travel restrictions, remote participation may better preserve equality of participation for all delegates from different geographical regions.    

 

 

·        The chairperson of each working group shall take steps to ensure an inclusive and transparent approach, including by adjusting the pace and organization of the meeting to accommodate online participants especially where they may be facing technological difficulties, integrating delegations participating online to the maximum extent so that they are on an equal footing with delegations participating in-person, and considering, where appropriate, the option of postponing resolution of issues to the next meeting or arriving at consensus through a written process.

 

 

·        OP 5: To better adapt the session to the circumstances, the chairperson of each working group in consultation with the UNCITRAL member States shall prepare a provisional agenda for each session and circulate it for comments to the delegations of the UNCITRAL member States prior to the session. If the chairperson does not hear otherwise from the UNCITRAL member States within 28 days, the agenda of the session will be considered adopted by the working group. If any delegation has expressed concerns during that period, the Chair shall organize consultations in order to reach consensus.   

 

·        OP 6: After the session, the chairperson of each working group shall circulate to the delegations of the UNCITRAL member States for comment a draft report of the session reflecting the deliberations and any conclusions reached during the session, prepared in a style adapted to the circumstances. If the chairperson does not hear otherwise from the UNCITRAL member States within 28 days, the report shall be considered adopted. If any delegations has submitted comments to the draft report, any following discussion shall be held in writing.
