ראו פרטים נוספים בהקשר להחלטה משוויץ שהועברה לאיתי מהמחלק הבין-לאומית , שימו לב שמדובר בערכאה שיפוטית אשר קיבלה את ההחלטה לראות בנישואין ככאלו שהתרחשו בשוויץ ברגע שאחד מהצדדים נכח פיזית בשוויץ ומכאן שהוחל הדין השוויצרי אשר פסל את הנישואין.
חשוב לשוב ולהדגיש שעוד לפני שאנו ניגשים לדין המהותי, עלינו להבחין איזה דין חל בכלל, מכאן שהשאלה היכן התקיימו הנישואין קריטית כדי שנוכל להכריע איזה דין חל ואז לקבוע מה דין התעודה.

Subject: החלטה בשוייץ - נישואים בזום
הי,
בהמשך להתכתבויות בנושא ההחלטה בשוייץ, והשאלה האם מדובר בערכאה שיפוטית שקיבלה שם את ההחלטה שלא להכיר בנישואי יוטה בזום,
בדקנו שוב מול מנהל המחלקה למשפט בין-לאומי פרטי במשרד המשפטים בשוייץ. הוא ציין בפנינו כי מדובר בערכאה שממלאת תפקיד שיפוטי בכל הקשור לסוגיות שקשורות לנישואין ומכאן שלדבריו, בכל הקשור לסוגיית ההכרה בנישואים, מדובר בהחלטה שיפוטית לכל דבר.

זה הסעיף הרלוונטי מתוך חוק המשפט הבין-לאומי הפרטי בשוויץ (סעיף 32):
1 A foreign decision or legal document regarding civil status shall be registered in the Swiss civil status registers if so ordered by the cantonal supervisory authority.
2 The entry is authorised if the requirements set out in Articles 25 to 27 are met.
3 The persons concerned shall first be heard if it is not established that the rights of the parties have been sufficiently respected during the proceedings in the foreign state where the decision was rendered.
