Malawi accedes to Convention on the Recognition and Enforcement of Foreign Arbitral Awards

The 167th country to become party to the Convention

 

With its accession to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (also commonly known as the "New York" Convention), effected on 4 March 2021, Malawi becomes the 167th State Party to the Convention. The Convention will enter into force for Malawi on 2 June 2021.

The "New York" Convention is widely recognized as a foundation instrument of international arbitration and requires courts of contracting States to give effect to an agreement to arbitrate when seized of an action in a matter covered by an arbitration agreement and to recognize and enforce awards made in other States, subject to specific limited exceptions.

Its mandate is to remove legal obstacles to international trade by progressively modernizing and harmonizing trade law. 马拉维加入《承认及执行外国仲裁裁决公约》

成为第167个加入该公约的国家

 

随着其加入《承认及执行外国仲裁裁决公约》（亦称《纽约公约》）的决定于2021年3月4日生效，马拉维成为该公约的第167个缔约国。该公约将于2021年6月2日起对其生效。

 《纽约公约》被广泛视为国际仲裁领域的基础性文件。该公约要求缔约国法院在除特定情形外，在处理仲裁协议所涵盖事项的案件时应落实该仲裁协议并承认与执行在其他国家作出的仲裁裁决。

말라위, 외국 중재판정의 승인 및 집행에 관한 협약에 가입

해당 협약의 167번째 회원국

 

외국 중재판정의 승인 및 집행에 관한 협약 (흔히 “뉴욕협약”으로도 알려져 있습니다)에 가입함으로써, 2021년 3월 4일 말라위는 본 협약의 167번째 체약국이 되었습니다. 본 협약은 말라위에 대해 2021년 6월 2일 발효될 예정입니다.

“뉴욕협약”은 국제중재의 기본규범으로 널리 인식되고 있으며, 동 협약은 중재합의가 다루는 사항에 관한 소송이 제기되었을 때 체약국의 법원에게 중재합의의 효력에 따라 중재에 회부할 것과 특정 제한된 예외를 제외하고는 타국에서 내려진 중재판정을 승인 및 집행할 것을 요구합니다.
