Dear Karl,

 

Further to our discussion over the phone today, and following the meeting of Mr. Zvi Kaplan with ESA DG Dordain last week in which they reiterated their determination to sign a cooperation agreement in January 2011, we have reviewed your draft agreement of 4 August and are able to accept all your changes, except the issue of immunities and privileges to Israeli citizens or permanent residents.

 

 Israel's current legislation prohibits the granting of any privileges and immunities, whether financial or criminal, to Israel's citizens and permanent residents. An agreement granting privileges and immunities, even if only limited criminal immunities, to Israel's citizens and residents will require special legislation, and will prevent the possibility of signing the Agreement in January 2011 or in the near to that date. Such legislation is a complicated and long process with no guarantee regarding the acceptance of such a law, as it is the prerogative of the Knesset (the Israeli parliament).

 

Therefore, I would suggest to find a pragmatic solution in order to complete the procedures before signature by January 2011.

Such solution could be to decide to leave this issue for an implementation agreement (MOU) that would be signed separately in the future and be part of this agreement, serving as a framework agreement.

 

If this could be accepted, I would immediately send you officially our approval to your draft agreement, excluding the a.m. issue.
