אין ספק שחיים חייב לנסוע. השאלה היא האם מומלץ שגם איסע עמו כדי לבחון את סוגיית סעיף 32(ב) שהיא סוגיית עזרה משפטית. הכנס יתמקד בסעיף זה. בנוסף, הפרופיל שלנו בכנס והקשרים שלנו יגבירו את הסיכויים להתקבל כצד לאמנה. כבר דאגתי למסור למר סגר כי אני בקשר עם Betty Shave ממשרד המשפטים בארה"ב והיא עונה על שאלותינו ומעודדת את הצטרפותנו לאמנה.

שוחחתי כעת עם בטי שאיבי ממשרד המשפטים בארה"ב. היא מסרה לי המידע הבא:
1. אם לא נקבל הזמנה בקרוב ל- Octopus, כדאי לנו לבקש הזמנה ממר סגר.
2. כדאי לנו לבקש ממר סגר העתק מכל המסמכים שפורסמו ע"י ה- Transborder Search Study Committee שהוא רשאי להעביר אלינו (כלומר מסמכים על סעיף 32(ב)).ה-Octopus יתמקד בסוגייה זו.
3. האמריקאים מתכוונים לשלוח 3-5 נציגים ל-Octopus. בדרך כלל נציגי מדינות שונות הם פרקליטים ו/או חוקרים.
4. בדרך כלל ב-Octopus מחלקים את המשתתפים לשתי קבוצות המקיימות דיונים בו-זמנית ולפיכך מומלץ לשלוח יותר מנציג אחד.
5. בסיום ה-Octopus מועצת אירופה תפרסם Resolution.
6. היות וישראל שוקלת הצטרפות לאמנה, יש מקום שהיא תשלח נציגים ל-Octopus.
7. אם ברצוננו לקבל פרופיל גבוה ניתן לבקש כעת ממר סגר למנות נציג ישראלי לאחד מהפאנלים. בתפקיד זה ניתן לנציג להעלות שאלות וסוגיות לדיון, כגון: עד כמה רחוק ניתן לקחת את ההסכמה שהתקבלה בהתאם לסעיף 32(ב).
8. אחת מהמטרות המרכזיות של ה-Octopus היא לעשות קשרים. לפיכך היא ממליצה שנציגי ישראל יהיו אנשים שממתחים ב-"Shmoozing".

Dear Betty,
Eli Rosenbaum spoke of you in glowing terms when I met him recently. It is nice to know that we have a professional colleague in common.
I hope you might be able to enlighten me regarding the "Octopus Convention" scheluded in June. We understood from Mr. Alexander Seger, Secretary of the Cybercrime Convention Committe that the Octopus Convention will focus on Section 32(b). As you will recall, from our conversation on the subject, this is the section that concerns me the most, due to the lack of clarity regarding its implications. Are you planning to participate in the Octopus Convention? Do you have any information or materials regarding the specific issues that will be dealt with, which you are at liberty to share with me? Mr. Seger recommended that we attend the Octopus Convention, and we would like to be prepared as best as possible. Regarding one of the subjects you and I discussed, it might interest you to know that Mr. Seger also stated that Section 32(b) is not subject to the interpretation that it permits authorities of State A to approach directly a person present in State B in order to get his consent under Section 32(b) without first receiving permission of the authorities of State B, since without an express authorization in a Convention, a Convention cannot be interpretted in a manner than conflicts with Customary International Law.
