אנא ראה להלן אישור לסעיפי דין זר וסמכות שיפוט בהסכם עם SHARE-ERIC:
אנו מאשרים את סעיפי תניית הדין וסמכות השיפוט שבמכתב ההצהרה לפי לנוסח עם התיקונים שביקשנו, למעט התיקון בס' 1(b), בהתאם לתשובתה של Marie-Louise Kemperman בדוא"ל מתאריך 13.9.13.
בהתאם לאמירה בסעיף 1(b), תשומת ליבכם לסעיף 15 לתקנת הא"א (מצ"ב), אשר מפנה לדיני אירופה ולדינים של מדינת המטה של הארגון, ולסמכות השיפוט של ה- Court of Justice of the European Communities. נזכיר כי במידה ויתעורר סכסוך, ההתדיינות במדינה זרה ולפי דינים זרים עלולה להיות מורכבת ויקרה.
כמו כן, בנסיבות העניין אין לנו התנגדות להעברת מכתב ההצהרה לארגון בטרם קבלת אישור מעודכן של הממשלה לכך. יחד עם זאת, יודגש כי ידרש אשרור הממשלה להצטרפות לארגון, לאחר שראש הממשלה (שר החוץ) יפרסם צו חסינויות בהתאם לחוק חסינויות או לאחר שיחוקק חוק מתאים.
יוער כי לאור נוסח ההצהרה, ישנה עדיפות להוצאת צו חסינויות, על פני חוק.
עוד נציין כי איננו רואים מניעה להכיר במכתב ההצהרה, בצירוף החלטת מועצת הארגון, התקנון והתקנות שלו, כאמנה לעניין הגדרת המנוח "חסינויות וזכויות יתר" בחוק חסינויות וזכויות יתר (ארגונים בין-לאומיים ומשלחות מיוחדות).
לבסוף, נבקש להסיר את התוספת שהוספה אתמול בס' 4 למכתב ההצהרה המתייחסת לאישור הממשלה, ונבקש לראות את הנוסח הסופי של ההצהרה בטרם העברתה לארגון.

The remarks that you make for the wording of the Template are fine as far as we are concerned and we can send it to the Commission as it is, except for
1(b), “its participation in “. This should remain in, since it is about the jurisdiction of the European Court”
I just talked to Paul Tuinder, from Research Infrastructure, European Commission DG Research & Innovation B3.
He said that in the Inter-Service Consultation that will take place when the application for the accession of Israel will be processed may contact us for clarifications if problems should appear. We should then contact you.

Attached please find our remarks regarding the letter for associated countries / third countries.
We are making the final consulations with the Ministry of Justice regarding the suitable legal procedure for recognition of the legal personality of SHARE ERIC and will initiate the relevant procedure as soon as possible.
However, please note that in case that a legislative procedure shall be required, its completion might take few months. That is the reason for our proposal in par. 4 of the letter and we hope it provides a suitable solution.
