אני רוצה להתאים את ס' 8 של כללי הפרוצדורה (נטל ההוכחה) לס' 8.6 להסכם, כמו שאמרנו, ויש לי התלבטות איך כדאי להתאים אותו.

נראה לי לא מתאים פשוט לאמץ את הנוסח של 8.6
 (Either Party may request consultations regarding any actual or proposed measure or any other matter that it considers affects the operation of this Agreement whether or not the matter has been notified...)

אז חשבתי לשלב באופן חלקי עם הסעיפים שראינו בהסכמים אחרים, שיש בהם כמה חלופות, באופן הבא:

Burden of Proof

8. A complaining Party asserting that an actual or proposed measure of the other Party is inconsistent with the provisions of this Agreement, or that any other matter affects the operation of this Agreement as a result of a failure of the other Party to carry out its obligations under this Agreement, shall have the burden of establishing such inconsistency.

אבל אני לא בטוחה אם זה יהיה מדויק, או לא מרחיב יותר מדי. מה את חושבת?
