Dear Colleagues ,
As indicated last week, the Chair of the
IGC invited Regional Coordinators last Monday, 12 July
2010 to a consultation concerning organizational matters
of the first IWG .
Here is a brief read out of the main
issues that we discussed during the consultations, as
well as the proposed follow-up
:

Election of the
Chair
and Vice-chairs
As informally indicated during our last
Group B meeting, we received yesterday the confirmation
from the Asian Group coordinator that
Ms
Savitri Suwansaphit (Ministry
of Culture)
from Thailand
would be available and interested in
chairing the first IWG. Ms
Suwansaphit followed the IGC since
years. She has a great experience
in TCE issues .
A CV of Ms Suwansaphit will be
circulated soon
.
The Asian Group remains nevertheless
open to discuss other possible
candidature(s ).
At this stage the coordinators of the
other groups
did not presented alternative candidatures and expressed
preliminary positive comments in support of the candidature
of Ms Suwansaphit .
The coordinator of the Group of Central Asia, Eastern Europe and Caucasus
indicated
that his Group is still consulting and may present a candidate
for the chairmanship or vice-chairmanship of the first
IWG
.
Regional coordinators recognized the
need to identify the Chair of the
first IWG ideally before the end of the
week, in order to enable her/him to prepare the meeting
.
A provisional list of participants to
the IWG is attached hereby for your consideration
.

Organization of
the
meeting / Work programm
The proposal of Group B to have a
briefing by the WIPO Secretariat
at the very beginning of the IWG was
welcomed by the other groups
.
All groups confirmed that there shall be
no general statements
at the beginning of the
IWG
.
The African Group made a proposal
concerning the
work program
of IWG/1: Days 1 and 2, discussions on the
policy objectives and general principle (preamble of
the draft international instrument); Days 3 and 4, discussion
on the substantive articles; Day 5 ,
clean out of the text and preparation of the report to the
IGC
.
While indicating his openness to
structure the work on such a basis, the coordinator of
the Asian Group seemed to have a preference to structure
the work of the IWG by looking at some specific issues
such as "collective ownership". The discussions may lead to draft
provisions and/or to recommendations to the IGC. A list of such key issues
(3 or 4) may circulate during this week for consideration by the other groups
.
As agreed during our last Group B
meeting, I indicated at this stage our openness for considering
the best way to structure the work of the IWG, while
mentioning some key points: the utility that the chair
may propose a work program at the very beginning of the meeting;
the importance to discuss the policy objectives and the general principles
and not only to limit the work of the experts to a drafting exercise
(i.e. part 3 of the main working document); our openness to extend the
working hours, if needed, and our request to start the meeting on time (so
far the plan
of teh Secretariat is to have meeting from 10:00 to 13:00
and from 15:00 to 18:00
).
The general impression was that all
these ideas/proposals might be quite easily arranged
in a consensual work plan for the week
.
No full fleshed report is expected by
the end of the IWG, but rather a
brief report on the concrete results of
the IWG
.
A detailed report will be prepared later on for the information
of the IWG. The way that some colleagues described the
format of the "detailed report" remains somehow ambiguous.
Group B favored, so far an information document prepared
by the Secretariat explaining / summarizing the discussions of
the experts without quoting them .

Organization of
the
meeting / Identification of the "experts "
Besides the "normal badge" that each
member of the delegations will receive for attending
the meeting, each delegation will receive an "orange
badge" with the name of
its country .
The "expert" of each delegation will have to show the "orange badge" for
entering in the plenary (Room A). Several experts of
a same delegation will therefore be able to take part
to the discussions in the plenary, but not simultaneously
.

in Room A at WIPO
in order to have a final exchange of
view among us before
the beginning of the IWG .
I stay nevertheless at your disposal to
organize a Group B meeting on Friday, July 16, 2010,
if needed. In such a case please indicate
your interest to have it
as soon as possible
.
