היי איתי וסדריק,

שוחחתי עם סורל על הצורך לקבל אישור הממשלה להצטרפות הרשמית לאריק, בעקבות שאלה שהעלה סדריק.

מבחינת לוחות הזמנים, על ישראל להעביר לארגון את הצהרת ההצטרפות שלה עד יום חמישי או שישי הקרוב (בתוך 10 ימים מהחלטת מועצת הארגון לאשר את הצטרפותה של ישראל ואת שינוי התקנון בהתאם; אחרת ההחלטה תתבטל).

סורל ציין שכבר ניתן אישור הממשלה להתחיל בהליך ההצטרפות, ובאותה ההחלטה המשרד לאזרחים ותיקים הוסמך לשלם דמי חבר לארגון, ניתנה הסמכה לעקוב אחר ביצוע הפרויקט וכו' (ראו נוסח החלטת הממשלה בהמשך), כלומר, הממשלה אישרה את ההצטרפות דה-פקטו. על כן, הוא סבור כי ניתן למסור את ההצהרה לארגון באופן מיידי, תוך תוספת בס' 4 בדבר הצורך באישור הממשלה (בנוסח שלהלן ובקובץ הרצ"ב) ולפעול במקביל לקבלת אישור הממשלה להצטרפות.

This Declaration shall enter into force on the date of the latter of the following written notifications: (a) the State of Israel's notification to SHARE-ERIC that its internal procedures for bringing this Declaration into force have been completed including approval by the Government of Israel, if needed,
אשמח מאד לשמוע אם ניתן לדעתכם למצוא פתרון שיאפשר את הצטרפותה של ישראל לארגון כאמור, ללא דיחוי...

הצטרפות מדינת ישראל כחברה בארגון SHARE-ERIC המבצע את סקר הבריאות, הזדקנות ופרישה באירופה
מחליטים
א. לאשר את פתיחת הליך הצטרפות מדינת ישראל לארגון SHARE-ERIC (להלן - הארגון) המבצע את סקר הבריאות, הזדקנות ופרישה באירופה (להלן - הפרויקט). ההצטרפות של ישראל תותנה בכך שהתיקונים שהתקבלו בתקנון הארגון בחודש ספטמבר 2012 יכנסו לתוקף.
ב. לייפות את כוחה של סגנית השר לאזרחים ותיקים להודיע לארגון על פתיחת ההליך להצטרפות של ישראל, בכפוף לכך שהתיקונים לתקנון הארגון שאושרו בישיבת מועצת הארגון בחודש ספטמבר 2012 יכנסו לתוקף, וזאת באישור משרד החוץ ובתיאום עם משרד המשפטים.
ג. למנות ועדת היגוי לפרויקט בראשות מנכ"ל המשרד לאזרחים ותיקים (להלן – המשרד) ובהשתתפות נציגי משרד האוצר, משרד החוץ, משרד המדע והטכנולוגיה, משרד המשפטים, משרד הרווחה והשירותים החברתיים, משרד הבריאות, משרד התעשייה המסחר והתעסוקה, המוסד לביטוח לאומי, הלשכה המרכזית לסטטיסטיקה, המועצה הלאומית לכלכלה והוועדה לתכנון ולתקצוב. החלטות הוועדה יהיו בהסכמה. הוועדה תזמן גורמים נוספים רלוונטיים ליטול חלק בעבודתה על פי הצורך. תפקידי הוועדה יהיו בין היתר פיקוח ומעקב אחר ביצוע הפרויקט ובחינת אופן הנגשת תוצאות הסקר המבוצע במסגרת הפרויקט לגופים העוסקים בתחום הזקנה.
ד. המשרד יהא אחראי לשלם לארגון דמי חברות (membership fee). מימון סכומים נוספים עבור ביצוע הפרויקט בישראל עד סוף שנת 2013 יתוקצב על ידי המשרד לאזרחים ותיקים בכפוף לחוק חובת המכרזים, התשנ"ב- 1992 ותקנותיו ובכפוף לכל דין.

הנוסח המחייב של החלטות הממשלה הינו הנוסח השמור במזכירות הממשלה. הנוסח המחייב של הצעות חוק ודברי חקיקה הנזכרים בהחלטות הינו הנוסח המתפרסם ברשומות. החלטות תקציביות כפופות לחוק התקציב השנתי. הנוסח המחייב של הצעות חוק ודברי חקיקה הנזכרים בהחלטות הינו הנוסח המתפרסם ברשומות.

The remarks that you make for the wording of the Template are fine as far as we are concerned and we can send it to the Commission as it is, except for

1(b), “its participation in “. This should remain in, since it is about the jurisdiction of the European Court”

I just talked to Paul Tuinder, from Research Infrastructure, European Commission DG Research & Innovation B3.

He said that in the Inter-Service Consultation that will take place when the application for the accession of Israel will be processed may contact us for clarifications if problems should appear. We should then contact you.

Dear Marie-Louise,

Attached please find our remarks regarding the letter for associated countries / third countries.

We are making the final consulations with the Ministry of Justice regarding the suitable legal procedure for recognition of the legal personality of SHARE ERIC and will initiate the relevant procedure as soon as possible.

However, please note that in case that a legislative procedure shall be required, its completion might take few months. That is the reason for our proposal in par. 4 of the letter and we hope it provides a suitable solution.
