Dear Erick,

 

Thanks you for sending us your views on the Commission position on comments received. Please note that the Commission position is submitted to the Joint Committee for discussion and that, as a consequence, an update of the document following your additional comments is not required. You can raise (of course) your additional comments during the meeting.

 

You will find our initial position on each of your comments below, which may help you to decide whether or not to raise them during the meeting. As a general remark, I would like to point out that the rules of procedure do not have any legal value and are just a 'modus operandi' about the organisation of the work of the committee. Furthermore, these rules of procedure can be amended later on, on the basis of experience.

 

Comment 1: we confirm (as we did in reply to comment 24). The EU is a single Contracting Party.

 

Comment 2: San Marino and Andorra do not participate on a regular basis, so we don't see the need to explicitly refer to them. We prefer the current wording which leaves some flexibility. We also see no need to explicitly state that EFTA and CEFTA do not have voting rights as they are not Contracting Parties.

 

Comment 10 (new): we could accept rephrasing of 5(2) as you suggested. As to 6(4), it should be noted that no formal vote takes place on the agenda. The question also arises what to do if a delegate objects to the agenda.

 

Comment 10 (old): we think that the text we suggested fully accommodates your concern. The sentence you suggest to add now (The chair shall set a reasonable period of time to allow any Contracting Party to object the proposed date) is unworkable for the Commission as meetings with interpretation have to be planned a long time on beforehand.

 

Comment 14: the word 'may' would seem to be sufficient.

 

Comment 15: we do not see the need for adding the additional sentence. If additional items communicated to us before the meeting are added, they will be included under AOB, in a revised version of the agenda.

 

Comment 26: the division of tasks between a sub-committee and working group in Article 13 is a bit artificial. So, it may be better to replace paragraphs 1 and 2 by a single paragraph: "1. A sub-committee or working group set up in accordance with Article 3(5) of the Convention may make recommendations, prepare decisions and carry out any other tasks delegated to it by the committee. Such a sub-committee or working group shall regularly report to the committee, at least 30 calendar days before each meeting of the committee."

 

Comment 27: Draft decisions will be submitted TO the committee for adoption. So, the sentence would seem to be correct.

 

Comment 28: Acceptable to us.

EU = 1 Contracting Party = 1 vote

10 MEDs Contracting Parties = 10 votes once the ratification is completed.

(for example, Jordan = 1 vote, Turkey = 1 vote, etc, etc…)

 

We will make it clear during the JC.
