Questions/Comments:

Question 8: „Located“ physically? If this is not meant by the formulation of the question, what is the difference to question 6.1?

 

Question 14.3/14.5: What is meant by “the principles”? Are FIUs aware of what is meant?

 

Question 14.5: Is accountability defined? Accountability to whom?

 

Question 15.1: Unclear as to why first tick box says “including financial institutions”. That is already more clearly defined in questions 15.2/15.3. If an FIU is in charge of supervision but not responsible for financial institutions the box will not be ticked. Also, unclear why questions 15.2 and 15.3 shall not be mandatory in such a case.

 

Question 16: The question should probably focus more on what type of activities fall under the AML/CFT legislation (i.e. who is considered to be a reporting entity) rather than solely focus on who is required to file an SAR/STR. If you are a reporting entity you are obliged to follow all AML/CFT obligations, including the filing of certain types of reports to the FIU.

 

Question 16.1: The standard does not allow for thresholds in relation to SAR/STR reporting!

 

Question 17.1: What if there are different thresholds for different activites/scenarios? This is the case in many jurisdictions.

 

Question 19: Purpose of this question remains unclear after replying to the previous question.

 

Question 20: Purpose of this question is also unclear. FIUs are obliged to do so.

 

Question 21: What is meant by “Investment regulation / supervisory authority”?

 

Question 23: “Other” should be an open field box. Otherwise it serves no statistical purpose in the context of the question.

 

Question 25: Seems irrelevant after answering the previous question as question 24 clearly indicates the type of exchange mode and differentiates between access, obtain and receive.

 

Question 26/27 and 27.1: No FIU will tick the box “No. My FIU does not disseminate information.” That FIU should be excluded from the Group immediately.

 

Question 32: This answer has already been given with reply to previous questions.

 

Question 35.1: What is meant by “any other information”?

 

Question 47 and 49: If an FIU “uses ESW” then question 49 becomes irrelevant.

 

Question 50.1: “Any other information” like what?

 

Question 61: What if there are no such systems built by FIU staff and contractors?

Dear Heads of FIU,

Please kindly be advised that the EC Information Management Reference Group has concluded the first phase of its work on the reassessment and further development of the Egmont Biennial Census (hereinafter EBC), as was requested by the EC during the meeting in Buenos Aires in March 2018. This inclusive process included complex consultations with the membership of the Egmont Working Groups, the EGS and the ECOFEL. Proposed amendments to the questionnaire were applied where it was feasible, bearing in mind aspects such as the effort required to fill in the questionnaire, the need to ensure comparability with the previous version and the tight deadlines for accomplishment of this task. The result is a draft questionnaire with some amendments to the existing one and a few additional questions taking into account the establishment of ECOFEL.

Following the decision made by the EC in Jakarta, you are kindly asked to review this final draft of the EBC 2019 (please see attached) and indicate any questions that may be difficult for completing or unclear to your FIU. If there are any such questions, please elaborate more on the reasons and the possibilities to address them. Please also be mindful that due to the tight technical deadlines and the need for the testing phase prior the launching of the EBC in July 2019, new questions as well as significant amendments cannot be accepted.

Having said that, you are kindly asked to provide your relevant inputs, if any, by February 28, 2019.
