Dear Heads of FIU,
In order to develop the information provided last 2 May 2019 regarding the situation of FIU Montenegro, please be advised of the following update.
In December 2018 the Europe II Regional Representatives were informed of proposed structural changes to the public administration in Montenegro that would affect, amongst others, the FIU (APMLTF). These changes would see the APMLTF cease to exist, with its authorities and powers being transferred to the Montenegro Police Administration.
Taking into consideration what is stipulated in the Addendum to the Membership Procedure, this required the work of an EC Sub-Committee formed by:
Following consideration, the EC Sub-Committee sent a letter to the APMLTF (dated 15 January 2019) requesting further information regarding the proposed changes and the situation of APMLTF:
In the above-mentioned letter the EC Sub-Committee made a strong recommendation that the functions of the APMLTF should remain within the APMLTF (under the existing legislation) until Egmont confirms that the new FIU meets the membership criteria. The APMLTF was warned that there could be consequences should Montenegro move the FIU functions to a new body without waiting for the Egmont process to conclude that the new FIU meets the Egmont membership requirements.
Nonetheless, the Regional Representatives for Europe II informed that whilst a Decree had been issued in Montenegro on 1 January 2019, transferring the functions of the APMLTF to the Police Administration, the Decree included provision for the APMLTF to continue, without change, while new legislation is enacted to define the structure of the Montenegro FIU within the Police Administration. Whilst this legislation is still awaited, the Regional Representatives determined that APMLTF has ceased to exist, with its authorities and powers being subsumed within the Police Administration. In light of this, it appeared to the Regional Representatives of Europe II that the ESW information would be available to persons who are not members of the Egmont member FIU, posing a security concern to such Information. As a consequence of this, the EC Sub-Committee met on 1 May 2019 during the Egmont Committee meeting In Sharm El Sheikh, Egypt, resulting in the Chair, in consultation with the Egmont Committee, suspending Montenegro's access to the ESW pursuant to section 6.2 B of the Egmont Charter.
Furthermore, and after a careful evaluation, the EC Sub-Committee reached the conclusion that indeed the APMLTF has ceased to exist, with its authorities and powers being subsumed within the Police Administration. In that sense, the new authority in Montenegro acting as the FIU will be advised in the need to apply for membership to the Egmont Group. In addition, the FSRB will be informed by the EG Chair about this situation.
