Dear Heads of FIU,
On 19 July 2018 FIU Nigeria (NFIU) informed about the entering into force of a new law providing the Legal Framework for the Nigerian Financial Intelligence Unit. This new law does not only try to address the concerns that led to the current suspension of the NFIU, but also brings several additional changes that needed to be assessed as well.
Taking into consideration what is stipulated in the Addendum to the Membership Procedure, the above mentioned situation required the work of an EC Sub-Committee formed by:
After reviewing the new law, compared with the previous legislation governing NFIU, the EC Sub-Committee concluded that there are no fundamental changes that may further affect the membership of NFIU (currently under suspension). This conclusion has been taken in accordance with Addendum to the “Egmont Group Membership Procedure” as read with the “Egmont Group Support and Compliance Process”.
Considering the above mentioned, now the MSCWG is analyzing the new law in order to determine if it addresses that concerns the led to the current suspension of NFIU, which are related to its operational autonomy and independence, as well as the protection of confidentiality.
