Message sent on behalf the EC Sub-Committee, consisting of the Egmont Group Committee Chair, the Chair of the Membership Support and Compliance Working Group, and the Regional Representatives for Europe I

Dear HoFIU,

Please be advised that FIU Estonia, through a letter dated 23 September 2020, notified the EGS about structural changes in their organization brought by AML Act 98 that will take effect from 1 January 2021. 

Taking into consideration that the applicable document for reviewing these types of cases is the “Addendum to the Egmont Group Membership Procedure as read with the Egmont Group Support and Compliance Process” (attached), and considering that the vacant positions in the EC have been recently covered, the assessment of this notification was conducted by an EC Sub-Committee formed by:


  • Chair of the Egmont Committee
  • Chair of the MSCWG
  • Regional Representatives (in this case, Europe I)

 

Among the main aspects that the EC Sub-Committee found in the new Act, it would be important to highlight the following: 

 

  • FIU Estonia will be moved from the Police Authority to the Ministry of Finance, having its operational autonomy and independence addressed in Section 53 of the new AML Act.
  • The new provisions dedicated to the newly established FIU seem to cover all relevant aspects concerning the organization, powers, tasks, including the capacity to undertake international cooperation with appropriate capacity. The provisions also take account of the updated international standards and of the more detailed and harmonized fifth EU AML/CFT Directive.
  • The majority of FIU Estonia’s staff will be transferred to the Ministry of Finance as well.
  • With the new Legal framework, FIU Estonia will have a new supervisory role and will leave the previous role of asset tracing to the LEA’s.

 After reviewing the information provided by FIU Estonia, the EC Sub-Committee concluded the following:

1. FIU Estonia’s notification would meet the members’ responsibility established in Section 4.1-B of the Charter: “all members will inform the Egmont Group Secretariat of  significant changes to their organizational structure, mandate and operational status, which may affect their eligibility as a member”.

2. The changes informed by FIU Estonia do not affect the Egmont admission criteria as such and seem not to result in a situation where the admitted member FIU can no longer be considered as an Egmont recognized FIU.

 The above-mentioned decision has been taken in accordance with the “Addendum to the Egmont Group Membership Procedure as read with the Egmont Group Support and Compliance Process” and has been already informed to the Egmont Committee and to FIU Estonia.
