The processing of personal data on the Internet is bedeviled by two difficult questions: 1) how to determine which data protection or privacy applies to the processing, and 2) what happens when two or more apparently conflicting laws (some of which may be from areas other than privacy) apply? Companies complain that the same processing is subject to a multitude of different laws; individuals are confused as to what law governs their rights; and regulators are forced to sort through the uncertainties. This panel will seek to clarify the various issues involved, and also to suggest some solutions. It will be based on a hypothetical case study to be discussed among the panelists.
